PART II -- TERMS OF USE (CONDICIONES DE USO)

5. Description of the Service

atseis is a free online multiplayer simulation game focused on small and medium-sized businesses. The Service allows Users to:

  • Invest in and manage a virtual small or medium-sized business within a simulated economic world.
  • Make operational, tactical, strategic, and directive decisions that affect the simulated business.
  • Compete against other Players and NPC (non-player character) businesses within a persistent game world.
  • View leaderboards, market data, financial statements, and other game information.
  • Learn and apply real business concepts in a simulated environment.

The Game operates on a simulation engine that processes game ticks at regular intervals. During each tick, production runs, market transactions occur, company finances are updated, and events may be triggered. The simulation runs continuously regardless of whether a Player is online.

No real money is involved in the Game. All currencies, transactions, assets, valuations, and financial figures within the Game are entirely simulated and fictional. They have no real-world monetary value whatsoever.

6. User Accounts

To access the Game, Users must create an account by providing:

  • A username (unique within the Platform).
  • A valid email address.
  • A password (which will be stored in hashed form only; FORGELAB never stores plain-text passwords).

The User is responsible for:

  • Providing accurate and truthful information during registration.
  • Maintaining the confidentiality and security of their account credentials.
  • All activity that occurs under their account.
  • Notifying FORGELAB immediately of any unauthorized use of their account.

Each User may only create and maintain one (1) account. Creating multiple accounts (multi-accounting) is strictly prohibited and may result in the suspension or termination of all associated accounts.

7. Account Deletion

Users may request the deletion of their account at any time through the Settings page within the Game interface. Account deletion is permanent and irreversible. Upon deletion:

  • The User's personal data (username, email, hashed password) will be permanently erased.
  • All associated game data (companies, decisions, financial records, game history) will be permanently erased.
  • The User's company within the active game world will cease operations and may be converted to an NPC entity or removed entirely, at the discretion of the administrator.
  • The deletion cannot be reversed. The User will need to create a new account and start from scratch if they wish to participate again.

8. Game Worlds, Resets, and NPC Companies

The Game operates within discrete "worlds" created and managed by FORGELAB administrators. Users should be aware of the following:

  • Game resets: Game worlds may be reset, archived, or terminated at any time at the sole discretion of FORGELAB. During a reset, all in-game data (companies, decisions, financial records, market history, leaderboard positions) may be partially or entirely deleted. No compensation of any kind is provided for lost game data.
  • NPC companies: Game worlds may contain computer-controlled companies (NPCs) that participate in the simulated economy. NPCs operate under the same simulation rules as Player companies but are controlled by automated logic. Their presence, behavior, and number are determined by FORGELAB and may change without notice.
  • Simulation mechanics: The simulation engine, including all formulas, constants, algorithms, event triggers, and balance parameters, may be adjusted, modified, or overhauled at any time without prior notice. FORGELAB reserves the right to change game mechanics to improve balance, fix exploits, or enhance the educational and entertainment value of the Game.
  • World parameters: Each game world has configurable parameters (tick speed, starting capital, market conditions, number of sectors, etc.) that are set by the administrator and may differ between worlds.

9. Waitlist

Games run in rounds. Users may join a waitlist by providing their LinkedIn profile URL and email address. This data will be used solely to notify Users when the next game round starts and to coordinate participation. Waitlist data is retained only until invitations for the next game round are sent, after which it is deleted. See the Privacy Policy for further details.

10. Acceptable Use

The User agrees not to:

  • Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
  • Attempt to gain unauthorized access to the Service, its servers, databases, or any systems or networks connected to the Service.
  • Interfere with, disrupt, or place an undue burden on the Service or the networks or servers connected to it.
  • Use bots, scripts, scrapers, or any automated means to access or interact with the Service, unless explicitly authorized by FORGELAB.
  • Exploit bugs, glitches, or vulnerabilities in the Game instead of reporting them to FORGELAB. Users who discover exploits are expected to report them promptly.
  • Collude with other Players in ways that undermine fair competition (e.g., coordinated market manipulation, dumping, or resource funneling between accounts).
  • Harass, abuse, threaten, impersonate, or intimidate other Users.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Create multiple accounts to gain an unfair advantage.
  • Share account credentials with third parties or allow others to access the Service through the User's account.

FORGELAB reserves the right to suspend or terminate the account of any User who violates these Terms, without prior notice and without liability.

FORGELAB does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Access to third-party websites is at the User's own risk.

13. Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

FORGELAB shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of, or inability to use, the Service.
  • Loss of game data due to resets, technical failures, server outages, or any other cause.
  • Interruptions, delays, errors, or defects in the Service.
  • Actions taken by other Users within the Game.
  • Decisions made by the User based on simulated game data, which has no real-world financial applicability.
  • Any damages resulting from unauthorized access to or alteration of the User's transmissions or data.

In no event shall FORGELAB's total liability to the User exceed zero euros (EUR 0.00), as the Service is provided entirely free of charge and no payment has been made by the User.

14. Disclaimer -- No Financial Advice

The Game is a simulation designed for educational and entertainment purposes. Nothing within the Game constitutes financial advice, investment advice, business advice, or any form of professional consulting. All financial figures, market data, valuations, and business metrics within the Game are entirely fictional. Users should not make real-world financial or business decisions based on any information presented within the Game.

15. Service Availability

FORGELAB does not guarantee uninterrupted or error-free access to the Service. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond FORGELAB's control. FORGELAB reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and without liability.

16. Modifications to These Terms

FORGELAB reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. It is the User's responsibility to review these Terms periodically. Continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If the User does not agree with the modified Terms, they must cease using the Service and may request the deletion of their account.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent court or authority, such provision shall be severed from the remaining Terms, which shall continue in full force and effect.

18. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Spain. For any disputes arising from or related to these Terms or the use of the Service, FORGELAB and the User agree to submit to the exclusive jurisdiction of the Courts and Tribunals of Malaga, Spain, except where mandatory consumer protection legislation provides otherwise.
